This Disclaimer governs your use of the website at https://www.chinaexpress.com.sg/ and the tours and services provided by China Express Travel (S) Pte Ltd (“China Express Travel”, “we”, “us” or “our”; UEN 199405859W), a travel agent licensed by the Singapore Tourism Board under the Travel Agents Act 1975. By using our website or booking our services, you agree to this Disclaimer.

1. We act as an agent

China Express Travel arranges tours, transport, accommodation and related services that are provided by independent third parties, including airlines, hotels, rail and charter-train operators (such as the Chengdu Hao Panda Train and the New Orient Express), cruise operators, ground operators and guides in China, coach and transport providers, restaurants, attractions and insurers. We act only as an agent for these suppliers. We do not own, operate or control them.

To the extent permitted by law, we are not liable for the acts, omissions, defaults, negligence, delays or insolvency of any supplier, or for any injury, illness, loss, damage or additional expense arising from them. Your recourse in respect of a supplier’s services is against that supplier, subject to that supplier’s own terms and conditions of carriage or contract. Nothing in this Disclaimer excludes or limits our liability for death or personal injury caused by our own negligence, or any other liability that cannot be excluded under Singapore law.

2. Force majeure

We are not liable for any failure or delay in performing our obligations, or for any change to your tour, caused by events beyond our reasonable control. These include adverse weather, natural disasters, fire, epidemics or pandemics and quarantine measures, war, terrorism, riot or civil unrest, strikes or industrial action, technical or transport failures, the closure of borders, airports or scenic areas, the suspension or refusal of permits, and the acts of any government or authority. In such an event we will make reasonable efforts to arrange comparable alternatives, but supplier charges may not be recoverable and refunds are not guaranteed.

3. Itinerary and prices

Itineraries, routings, sightseeing, hotels, meals and train or cruise arrangements may be varied for operational reasons or reasons beyond our control, and comparable substitutes may be provided. Prices are subject to change until your booking is confirmed and fully paid, for reasons including currency movements, fuel surcharges, airport and government taxes, and supplier rate changes. Escorted departures require a minimum group size to proceed; if the minimum is not met, we may cancel, postpone or offer an alternative. Where we cancel a departure, our liability is limited to a refund of monies paid to us, or transfer to another tour, and we are not liable for other costs you may have incurred, such as visas, insurance or independently booked flights.

4. Website content

Information and images on this website are provided for general reference only. They may be updated or withdrawn at any time and are provided without any warranty as to accuracy, completeness or fitness for a particular purpose. Actual scenery, hotels, room categories, meals, train cabins and inclusions may differ from those shown. Where there is any conflict, your confirmed booking documents and final itinerary prevail over the website. Links to third-party websites are provided for convenience only; we do not endorse or control them and are not responsible for their content. We reserve the right to correct any error on the website.

5. Your responsibilities as a traveller

• holding a valid passport with at least six months’ validity beyond your date of travel, with sufficient blank pages;
• obtaining the correct China visa and meeting all entry requirements for your nationality. We may assist with visa applications, but we do not guarantee that a visa will be issued, and a visa refusal is not our responsibility;
• being aware that certain destinations, such as Tibet and some Tibetan-inhabited areas of Sichuan, Qinghai and Yunnan, and parts of Xinjiang, require special permits that can only be arranged through licensed operators and may be restricted or refused by the authorities at short notice;
• arranging adequate travel insurance, which we strongly recommend, covering medical treatment, emergency evacuation, trip cancellation and curtailment, delay and baggage;
• assessing your own health and fitness for the tour. Some of our journeys include high-altitude segments (for example in Tibet, Qinghai and western Sichuan, above 3,000 metres), long touring days and remote areas with limited medical access. You should consult a doctor if in doubt, and the decision to travel is yours alone;
• complying with the laws, regulations and customs of China and any countries visited; and
• providing accurate personal and booking details (including your name exactly as shown in your passport) and arriving punctually. We are not liable for any loss arising from inaccurate information that you provide.

6. Booking and payment

A booking is confirmed only when we issue written confirmation and the required deposit is received. We accept payment by bank transfer and PayNow only; we do not accept online card payment. Deposits, balance payment dates, and cancellation and amendment charges are as set out in your quotation and booking confirmation. Bookings are held on cleared funds.

7. Intellectual property

All content on this website, including text, itineraries, photographs, logos and the China Express Travel and 新加坡华运旅游 names and marks, is owned by or licensed to us and protected by copyright and trademark law. You may view it for personal, non-commercial reference only. You may not copy, reproduce, redistribute, resell or otherwise use it for commercial purposes without our written permission. Third-party names and marks are the property of their respective owners.

8. Governing law

This Disclaimer, and any dispute arising from it or from your use of our website or services, is governed by the laws of Singapore, and you submit to the non-exclusive jurisdiction of the Singapore courts.
